Capacity in completing this form
We'll only accept the form from someone other than the individual making this application where the person is incapable of dealing with their affairs due to mental or physical incapacity. The following people may complete the form:
- In England and Wales or Northern Ireland, a donee of a lasting power of attorney (within the meaning of the Mental Capacity Act 2005) or deputy appointed for the individual by the Court of Protection.
- In Scotland, the individual’s guardian within the meaning of the Adults with Incapacity (Scotland) Act 2000.
- In a country or territory outside the UK, a person authorised under the laws of that country or territory to deal with the individual’s property and affairs.
For persons who are not physically capable of dealing with the application form we will recognise ordinary powers of attorney or, in accordance with the Mental Capacity Act 2005, an enduring power of attorney executed before 1 October 2007.
